Proposed amendments to the UK’s greenhouse gas emissions trading scheme regulations (Consultation URN 13D/198), along with early-2013 legislation already passed but yet to be translated into new guidance by the Environment Agency, will endanger the integrity of the ETS scheme in the UK, primarily by making fines ‘discretionary’ and removing criminal penalties.
